A Kisumu man has been sentenced to death for violently stealing a car worth Ksh 1.8 million in the Kogutu area of Muhoroni sub-county, Kisumu County.
Tamu Law Courts Senior Principal Magistrate Amos Mokoross found the accused guilty of two counts of robbery with violence, contrary to Section 296(2) of the Penal Code, and stupefying in order to commit a felony, contrary to Section 230.
The court heard that the accused, Kevin Onyango Kiyogo, armed with dangerous weapons, used actual violence to rob James Kamau of his Toyota Hilux on June 23, 2023.
In addition, Kiyogo was charged with administering an overpowering drug to the victim during the commission of the crime.
The prosecution, led by Ms. Beatrice Langat, lined up eight witnesses in the cases and evidence which implicated the accused in the crime, alongside accomplices who remain at large.
In delivering the judgment, Magistrate Mokoross sentenced the accused to death for the first count of robbery with violence while for the second count he received a five-year prison sentence.
The death sentence will be held in abeyance until the completion of the five-year term.
