The Supreme Court has given the Ethics and Anti-Corruption Commission (EACC) the green light to seize Ksh114M and seven prime properties belonging to former Nairobi Chief Finance Officer Jimmy Kiamba.
The five Judge bench led by Justice Mohamed Ibrahim dismissed Kiamba’s final attempt to appeal a decision which had affirmed the High Court’s finding that he and his associates had unexplained wealth.
The court ruled that the assets were proceeds of corruption and economic crimes. The prime properties are in Runda, Dennis Pritt Road and South C in Nairobi, with an estimated market value of over Ksh500,000,000 and Ksh113,893,743 held in various bank accounts, belonging to Kiamba, his wife and associates.
In the case, Kiamba had moved to the Appellate Court seeking to overturn the High Court’s decision that he had unexplained assets.
In February this year, the Court of Appeal upheld the High Court ruling in favor of EACC. Displeased by the Judgment, Kiamba and his associates filed a Petition at the Supreme Court seeking to overturn the CoA decision.
He also filed an application seeking conservatory orders to stay the execution of the Judgment in the guise that the petition raised a question of constitutional interpretation.
However, EACC filed a replying affidavit in opposition to both the application and the petition. Kiamba is accused of having wealth that is not commensurate to his known legitimate sources of income.
