The Business Registration Service (BRS) has taken over the registration and incorporation of trusts with immediate effect.
This follows amendment of the Trustees (Perpetual Succession) Act which effected the transfer of the functions from the State Department of Lands and Physical Planning.
“Effective Wednesday 22nd May 2024 the State Department of Lands and Physical Planning shall cease receiving applications for registration and incorporation of trusts,” read a public notice by BRS.
Targeted trusts include those run by trustees who have been appointed by any body or association of persons established for any religious, educational, literary, scientific, social, athletic or charitable purpose, or who have constituted themselves for any such purpose, or the trustees of a pension fund.
BRS now expects to start receiving applications beginning June 3, 2024 to allow a smooth transition between the two offices as Nairobi Central Registry completes all pending applications.
