Political activist charged with offensive conduct

A political activist has been charged with offensive conduct at a public gathering.

Shadrach Omondi Orwa alias Omosh Jakababa was charged before Milimani Principal Magistrate Gilbert Shikwe who freed him on a cash bail of Ksh 50,000.

‘Jakababa’ was charged that on May 9, 2023, at unknown place within the Republic of Kenya at a public gathering used offensive, abusive words intended to provoke a breach of peace.

He allegedly asked Baba (Opposition leader Raila Odinga) to go to Russia to bring firearms to enable people invade State House”.

The words uttered in Swahili are ” Baba enda Russia utuletee bunduki, maaskari wote wakae raia, kila mtu apewe bunduki yake tuingie statehouse…” with intent to cause breach of peace.

Asking the Court to release the suspect on bond, defence lawyer Danstan Omari said that the accused is not a threat to national security and was expressing his opinion when he allegedly uttered the said words at a public gathering.

Omari defended the accused arguing he was only expressing his views on the high cost of living.

“I urge this court not to fall into the trap of the political class who are agitating for the prosecution of harmless and innocent Kenyans.” Said Omari.

He urged the magistrate to invoke its discretion in favour of the accused and free him on affordable cash bail.

The state prosecutor Abel Omariba did not oppose the bail application.

Mr. Shikwe in a brief ruling said the offence is bailable and proceeded to grant him a cash bail of Ksh 50,000.

The case will be mentioned on August 2 for pretrial directions.

Jakababa was arrested from Kisumu and transferred to Nairobi for investigations on July 10.
